Makeship #DTIYS 5TH ANNIVERSARY Contest
Official Rules
1.
ELIGIBILITY: To participate in the #MakeshipDTIYS (“Contest”), you must: (a) be a legal resident of the United States, Canada (VOID in Quebec), or any other country in which a promotion of the kind made by the Contest is legal, and not subject to any additional restrictions such as registration, localization or bonding; (b) at least sixteen (16) years of age, at the time of entry; (c) if you are under the legal age of majority in your primary residence, (a “Minor”), get your parent or legal guardian’s permission to participate in the Contest (Minor entrants will be required to provide parental consent before they can be declared a winner and any prize can be awarded under these Rules); and
Employees, and members of their immediate families and households of the sponsor, Makeship Inc. (“Makeship”), its subsidiaries, affiliated companies, and anyone else involved in the handling of the Contest (including any affiliated content creators) are not eligible to participate and/or win. The Contest is void where prohibited or restricted. Limit one entry per person.
2.
ENTRY PERIOD: The Contest entry period begins on July 4th, 2023 at 3PM ET and ends on July 23rd, 2023 at 12PM ET (“Entry Period”).

HOW TO ENTER: Eligible entrants may enter by: (1) posting a public Twitter or Instagram post with the hashtag #MakeshipDTIYS during the Entry Period (“Entry Post”) and (2) following the @makeship account on the platform on which the Entry Post was submitted.
The Entry Post should include a photograph, reproduction or link to an original artwork created by the Entrant, which recreates or reinterprets the image of the Makeship mascot Fiya celebrating its birthday post at a the Contest launch in the entrant’s own artistic style. All artistic mediums are accepted, including but not limited to traditional and digital drawings, ceramic and clay, comics, cosplays, and mixed media. However, artwork generated or substantially assisted using any form of artificial intelligence or generative machine assistance is not eligible.
No more than one Entry Post can be made during the Entry Period, and the Entry Post must remain public until the winner is decided in order to be valid.

SELECTION PROCESS: Entry Posts will be judged primarily on three main criteria: originality, impact, and medium. After the Entry Period, employees of Makeship will review all eligible Entry Posts against these criteria and nominate fifteen (15) shortlisted selections. The list of selections will be provided to Makeship’s design team, who will score the submissions based on the three criteria of creativity, impact and medium, with each criteria receiving a score out of 10. The five (5) submissions with the highest overall score will be announced as winners and notified on Makeship’s Instagram and Twitter by public post and/or private message on August 3rd, 2023, at 3PM ET.
If a winner does not meet the stated eligibility requirements, or claim the prize by responding to Makeship’s posts, such winner may be deemed disqualified and Makeship reserves the right to select an alternate winner from the shortlist. Winners may be required to sign and return an Affidavit of Eligibility, and, where legally permissible, a publicity release and/or provide other personal or tax information. If a potential winner is a Minor, any required documents must be signed by a parent or legal guardian. Makeship’s decisions concerning selection of winners, as well as all other matters relating to the Contest, are final and binding.
5.
PRIZES/ODDS: The number and value of prizes awarded are as follows:
The top 4 runner-up winners will each receive a US$50 Makeship gift card and a Fiya plush toy.
The grand prize winner will receive an iPad 10 with an Apple Pencil (approx. $850 CAD in value).
Prizes may not be substituted, transferred or assigned except at Makeship’s sole discretion. All taxes and other expenses not listed in these Rules are winner’s responsibility.
6.
USER CREATED CONTENT: In respect of any creative material submitted by you, including but not limited to, user created content, by submitting your Entry Post: (1) you verify that you are the owner and producer of the submitted material and that no third party ownership rights exist to any material submitted, (2) you verify that the material is not obscene, defamatory, or otherwise illegal.
7.
LIMITATION ON LIABILITY: Entrants release, discharge, and agree to indemnify and hold harmless, Makeship, Instagram, Twitter and the other social media sites and their respective directors, officers, employees, parents, subsidiaries, affiliates, agents and representatives (the “Released Parties”) from and against any claims or liability for any damages, injury or losses (including death) to any person, or property, of any kind resulting in whole or in part, directly or indirectly from acceptance, possession, misuse or use of any prize or participation in the Contest.
8.
GENERAL CONDITIONS: The Released Parties are not responsible for technical, network, electronic, computer, hardware or software failures of any kind, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any materials related to the Contest. The Released Parties are not responsible for incomplete, garbled or delayed Internet/e-mail computer entries or for any malfunction or technical errors occurring on any social media site on which the Contest is conducted. In the event that technical or other circumstances compromise a Contest, Makeship reserves the right to cancel, modify or terminate the Contest, and/or to select winners for prizes from all eligible entries received prior to the cancellation. The Released Parties are not responsible for typographical errors in the Contest, any social media site or these Rules.
9.
CLAIMS/CHOICE OF LAW: All issues and questions concerning the Official Rules, or the rights and obligations of entrant in connection with the Contest, shall be governed by, and construed in accordance with, the laws of British Columbia, Canada, without regard for conflicts of law doctrine, and all proceedings shall take place in British Columbia. All participants who enter the Contest agree to submit to the exclusive jurisdiction of the courts of British Columbia, Canada. Any and all claims, judgments and awards in connection with the Contest shall be limited to actual out-of-pocket costs incurred but in no event attorney’s fees; and under no circumstances will an entrant be permitted to obtain awards for, and entrants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses.
10.
PUBLICITY/RELEASE: Except where prohibited by law or regulation, by entering and/or accepting a prize you grant Makeship permission to use your name, username/online alias, likeness, and any user generated content for any promotional purposes without additional compensation, consideration or consent. Makeship’s use of all information collected from participants will be in accordance with its privacy policy, found at https://www.makeship.com/policies/privacy-policy. Makeship reserves the right to use any response or submission in all media, and to edit any response or submission for brevity and clarity. Any information provided is to Makeship and not to Twitter, Instagram or other social media sites.
This Contest is not in any way sponsored, endorsed or administered by, Twitter, Instagram or any other social media sites.
